According to the USDA’s National Agricultural Statistics Service, 86% of farms in the U.S. are structured as sole proprietorships and 7% as partnerships.  This does not necessarily mean that these people have chose the best business structure for their farms, in fact it is more than likely a failure to look into other business structures and plan properly for the best possibility tax situation and the easiest continuation of existence of the farm by passing it on to future generations. Limited Liability Companies is one business structure that we feel farms should invest some time in looking into; this structure separates the responsibility of the farms actions from the family so in the case of an incident the family could not be held liability for what the farm has done. One must understand that all structures have advantages and disadvantages. Another thing that has come into play with local farms is the EPA involvement in farming communities. The EPA is demanding compliance with farms on such issues as pesticides, animal waste management, groundwater quality, surface water, wetlands preservation, allocation of water recourses, drainage, tanks/ containment and solid/hazardous waste.
